Although most commercial aviation cases are settled before a trial is commenced, our attorneys here at Baum, Hedlund, Aristei & Goldman organize each and every case as if it were going to trial. This has a preferable effect on how defendants behave in settlement negotiations and trial.

Different clients have different preferences when it comes to how their case is handled. Some would rather see their case resolved without having to go to trial, where others would like a trial to gain the results they are looking for. We always work in our client’s best interests regardless of what the final outcome may be.
Our latest aviation trial was in Los Angeles in June 2006 and was a products liability lawsuit against Bell Helicopter for a tail rotor malfunction. We represented the families of three Los Angeles Fire Department paramedics who perished in a helicopter crash during an air rescue attempt. (Due to an earlier Appeals Court decision on this case, aviation product liability law was changed because of our argument that civilian aircraft should have the same safety standards as military aircraft.) The case was resolved in the third week of trial.
In 2003, Baum Hedlund co-tried an aviation case in Southern California where we represented the family of a 22 year old woman who had been killed in a Gulfstream III charter jet that was owned by Airborne Charter Inc., and operated by Avjet. The plane was taking 15 passengers to Aspen from Los Angeles and crashed when it landed more than 2,000 feet in front of the runway. Avjet Corp arrived at an $11.7 million settlement with the families of three of the crash fatality victims. A Los Angeles jury was about to commence the punitive phase of the trial when this settlement was reached. Baum Hedlund’s clients settled for $9.5 million following the jury awarding them $8.5 million in compensatory damages.
